Any questions related to your family or to inquire about the applicant’s pregnancy plans, number of children, or the children’s age status are technically illegal. But employers often ask these questions to get a read on your future commitment to the job and company.
So in case you’re asked, you can very much voice out your opinion to the interviewer and ask him to speak about the job description and steer the conversation back to a job-related topic.
However, after the applicant has been hired, they can be asked about their marital status, spouse’s age and the number and ages of dependents for tax and insurance reasons.
Arrest Records
An employer can't actually legally ask you about your arrest record, but they can ask if you've ever been convicted of a crime. Depending on the circumstances, it is also unlawful to conduct a background check into an applicant’s history of arrests records unless the information is related to the job.
However, depending on your state and the type of job for which you are applying, the employer can actually check your criminal record as part of an employment background check and nothing related to your personal issues.
