Essential Services Maintenance Bill: A Much Needed Relief to General Public
Bangalore: Here is a much needed relief for the general public! Professionals associated with essential service sectors can no longer go on strike, as per the latest Karnataka Essential Services Maintenance Bill (ESMA). And once the bill is passed, such acts will be considered as non-bailable offense, reports ND Shiva Kumar of TNN.
The bill is expected to be tabled in the winter session of the state legislature in Belgaum. And once it is approved, the police get the authority to detain a striking employee without warrant. This is intended to put an end to the inconvenience caused to people when the essential service workers go on strikes.
As per ESMA, every service associated with the transmission, production, generation, storage, supply or distribution of water or electricity and any transportation service for the carriage of passengers or goods by motor vehicles comes under the ambit of essential services. The bill also grants authority to the state to assert even those services that fall under the control of the government according to List II of the 7th Schedule of the Constitution, as essential services.
The individuals who initiated the strike or took part in it will be punished with a sentence of up to one year or with fine up to 5,000 or both. Those who were caught for promoting or financing the strike are also liable for the same kind of punishment.
